Welcome to Wanderlust Tours, Inc. ("Wanderlust," "we," "us," or "our"). These Terms & Conditions govern your use of our website, mobile applications, and services. By accessing or using our platform, you agree to be bound by these terms. If you do not agree, please do not use our services.

Section 1

Acceptance of Terms

By creating an account, making a booking, or otherwise accessing our services, you confirm that:

  • You are at least 18 years of age, or are accessing the service under the supervision of a parent or legal guardian.
  • You have the legal authority to enter into a binding agreement on behalf of yourself or any person you represent.
  • You have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy.
  • All information you provide to us is accurate, complete, and up to date.
Note: If you are booking on behalf of a group, you are responsible for ensuring all members of your group comply with these terms and are aware of the relevant policies.
Section 2

Bookings & Reservations

All bookings made through Wanderlust are subject to availability and confirmation. A booking is only confirmed once you receive a booking confirmation email with a unique reference number.

2.1 Booking Process

Select your tour or hotel, choose your package and dates, complete the payment, and await your confirmation email. We reserve the right to decline any booking at our sole discretion without providing a reason.

2.2 Accuracy of Information

You are responsible for ensuring all booking details — including names, dates, guest counts, and contact information — are accurate. Wanderlust cannot be held liable for losses arising from incorrect information provided at the time of booking.

2.3 Minimum Age for Tours

The lead booker must be at least 18 years old. Children under 5 travel free. Children aged 5–17 are charged at 70% of the adult rate. Some tours have specific age restrictions as noted on the tour detail page.

Section 3

Payments & Pricing

All prices are quoted in United States Dollars (USD) and are inclusive of a 5% service fee. Prices are subject to change without notice, but confirmed bookings will honour the price at the time of booking.

3.1 Accepted Payment Methods

  • Credit cards: Visa, Mastercard, American Express
  • Debit cards (where supported by your issuing bank)
  • PayPal

3.2 Payment Security

All card payments are processed by Stripe, a PCI-DSS Level 1 certified payment processor. Wanderlust does not store your full card details on our servers.

3.3 Currency Conversion

If your bank account is in a currency other than USD, your bank will apply their standard foreign exchange rate. Wanderlust is not responsible for any conversion fees or exchange rate differences.

Refund Processing: Refunds are initiated within 24 hours of approval. Funds may take 3–7 business days to appear in your account depending on your bank. PayPal refunds are typically instant.

To cancel a booking, email hello@wanderlust.com with your booking reference, or manage cancellations through your account dashboard.

Section 5

User Conduct

You agree to use our platform and services responsibly and lawfully. The following conduct is strictly prohibited:

  • Providing false or misleading information during registration or booking.
  • Engaging in harassment, intimidation, or abusive behaviour toward guides, staff, or other travellers.
  • Reproducing, distributing, or commercially exploiting any content from our platform without written permission.
  • Attempting to circumvent our booking system or payment process.
  • Posting fraudulent, defamatory, or offensive reviews.
  • Soliciting personal services directly from guides, bypassing the Wanderlust platform.

Wanderlust reserves the right to suspend or terminate accounts that violate these conduct standards, without refund.

Section 6

Limitation of Liability

Wanderlust acts as a marketplace connecting travellers with independent local guides and accommodation partners. While we vet all partners carefully, we are not directly responsible for the actions, omissions, or quality of third-party service providers.

To the maximum extent permitted by law, Wanderlust's total liability to you for any claim arising from the use of our services shall not exceed the total amount paid by you for the relevant booking.

Wanderlust is not liable for:

  • Loss or damage to personal belongings during tours or hotel stays.
  • Personal injury arising from participation in adventure activities.
  • Losses caused by events outside our reasonable control (force majeure), including natural disasters, war, or government travel advisories.
  • Indirect, incidental, or consequential losses of any kind.
Recommendation: We strongly advise all travellers to obtain comprehensive travel insurance before departure, covering trip cancellation, medical emergencies, and personal liability.
Section 7

Privacy & Data

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. In summary:

  • We collect personal data (name, email, payment details) only as necessary to provide our services.
  • We do not sell your personal data to third parties.
  • We use industry-standard encryption to protect data in transit and at rest.
  • You may request deletion of your account and associated data at any time by contacting us.
  • We may share data with trusted service providers (e.g., Stripe for payments) under strict data processing agreements.

Section 8

Intellectual Property

All content on the Wanderlust platform — including text, photographs, logos, tour descriptions, design elements, and software — is owned by or licensed to Wanderlust Tours, Inc. and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, modify, distribute, or create derivative works from any of our content without our express written consent. Personal, non-commercial use (e.g., sharing a tour page link) is permitted.

By submitting a review or any user-generated content to our platform, you grant Wanderlust a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with our services.

Section 9

Changes to These Terms

Wanderlust reserves the right to modify these Terms & Conditions at any time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page.
  • Send a notification email to all registered users at least 14 days before changes take effect.
  • Display a prominent notice on our website.

Continued use of our services after the effective date constitutes your acceptance of the revised terms. If you do not agree to the changes, you must discontinue using our services before the effective date.

Section 10

Governing Law & Disputes

These Terms & Conditions are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

Any dispute arising from or relating to these terms or our services shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association.

You agree to waive any right to bring a class action lawsuit against Wanderlust. Nothing in this clause limits your statutory rights as a consumer.
